TinyTunz is a U.S.-based service currently being formed as a business entity. Orders are accepted only from adults. These Terms and Privacy Policy apply to use of the TinyTunz website and personalized-song service.
1. Service and Adult Customers
TinyTunz creates personalized songs for children from information submitted by an adult customer, such as a parent, guardian, grandparent, relative, or other authorized adult. Children should not place orders or submit personal information directly through the service.
2. Customer Responsibility
The customer is responsible for providing accurate order details and confirming that they are authorized to share the information submitted about the child and any other person mentioned in the order.
3. Personalized Production
Each TinyTunz song is custom-made from the customer’s submitted details. Production begins when TinyTunz starts the personalized creation process for the order, including when a team member approves or starts an AI-assisted generation step.
4. Cancellation, Refunds, and Corrections
- Before production begins: the customer may request cancellation and a full refund.
- After production begins: because the order is personalized, it is generally non-refundable for a change of mind, except where applicable law requires otherwise.
- TinyTunz error: if TinyTunz makes a material error compared with the submitted order details, TinyTunz will first offer an appropriate correction or replacement at no additional charge. If TinyTunz cannot reasonably correct the issue, a partial or full refund may be issued.
- Non-delivery: if TinyTunz is unable to deliver the purchased personalized song, the affected amount will be refunded.
- Duplicate charge or payment error: a verified duplicate charge or payment error attributable to TinyTunz or its payment flow will be corrected or refunded.
- 3-Song Pack: if TinyTunz is unable to deliver one or more songs in a $45 pack, each undelivered song may be refunded at $15.
Approved refunds are returned to the original payment method. The time for a refund to appear depends on the payment provider and the customer’s bank. Nothing in this policy limits mandatory consumer rights that cannot legally be waived.
5. Personal and Family Use
The delivered song is intended for personal, private, and family use. Private sharing with family or close contacts is allowed. Personal social sharing is allowed when it is non-commercial, lawful, and does not misrepresent TinyTunz or violate the rights of others.
6. Prohibited Uses
- Reselling or commercially distributing the song without written authorization.
- Using the song in commercial advertising without written permission.
- Using TinyTunz content or services for unlawful, harmful, deceptive, or infringing purposes.
7. Marketing Use by TinyTunz
TinyTunz will not use a customer’s personalized song as a public example or marketing reference unless the customer gives separate, explicit permission, such as through the optional marketing checkbox or a later written approval. Marketing consent may be revoked for future use.
8. Payments and Delivery
Payment processing is handled through a secure third-party payment provider. TinyTunz does not ask customers to send card numbers through the order or support forms. Current prices are $20 for a Single Song and $45 for a 3-Song Pack. The current estimated delivery time is 48–72 hours after the order is accepted for production, unless the customer is notified of a different timeframe.
9. Business Status and Governing Law
TinyTunz is operated from the United States and its operating business entity is currently being formed. Final entity and state-registration details will be added when formation is completed. To the extent permitted by law, these Terms are governed by applicable U.S. law and, once the entity is formed, the law of its state of registration, without limiting mandatory consumer protections that apply in a customer’s jurisdiction.
Privacy Policy
1. What We Collect
TinyTunz collects information submitted by the adult customer that is reasonably needed to create, manage, support, and deliver a personalized song. This may include the adult customer’s name and email and child-related creative details voluntarily supplied by the adult customer, such as first name or nickname, age, personality, memories, loved ones, preferred language, style, mood, or message. Payment-card entry and payment processing are handled by the payment provider.
2. How We Use Information
- To create, review, produce, and deliver the personalized song ordered by the customer.
- To communicate about the order, payment status, delivery, corrections, or support.
- To process payments and maintain transaction, accounting, fraud-prevention, and dispute records.
- To protect TinyTunz, customers, and the service from abuse or security incidents.
3. Children’s Information
TinyTunz is designed for adult customers. Children should not submit orders or personal information directly. Child-related details used for a song are provided voluntarily by an adult customer. TinyTunz does not sell child-related personal information and does not use a personalized song for public marketing without the adult customer’s separate permission.
4. Third-Party Services
TinyTunz may use service providers for payment processing, hosting, secure data storage, order management, email delivery, support, and AI-assisted song creation. Information is shared only as reasonably necessary for those providers to perform their functions, subject to their applicable contractual, security, and privacy obligations.
5. International Data Transfers
Because TinyTunz is operated from the United States, information submitted by customers outside the United States may be transferred to and processed in the United States or other locations where TinyTunz service providers operate. TinyTunz will use appropriate safeguards where required by applicable law.
6. Data Retention
TinyTunz retains order and child-related creative details only for as long as reasonably necessary to create and deliver the order, provide support and corrections, protect against fraud or disputes, and meet legal or accounting obligations. Information that is no longer reasonably needed may be deleted or de-identified. Billing and transaction records may be retained for longer periods when required for accounting, tax, fraud-prevention, dispute, or legal purposes.
7. Your Privacy Choices and Rights
Depending on applicable law, customers may have rights to request access, correction, deletion, portability, restriction, or objection concerning personal information. Customers may contact TinyTunz Support to make a privacy request. TinyTunz may need to verify the requester before acting on certain requests.
8. No Sale of Personal Data
TinyTunz does not sell customer or child-related personal information.
9. Cookies and Tracking
TinyTunz may use strictly necessary technologies required to operate the website. If analytics, advertising, or other non-essential tracking technologies are introduced, TinyTunz will provide any notice or consent mechanism required by applicable law.
